Is It Time For The Australian Government and The Jewish Community to Overthrow Chabad Religious Cult Leadership?

I would urge the community to give serious consideration to forcing the trustees to hand the [Chabad] Yeshivah Centre over to capable and independent trustees who can administer the Centre professionally until such time as the community has developed the appropriate structures to have it back. Ultimately it’s the safety and wellbeing of our children – past and present – that we are dealing with. And this must always come first.”

Manny Waks, who was the lead victim in the Melbourne Chabad child sex abuse scandal, writes about the new letter (and the 1973 letter it is based on) from Chabad’s international leadership.

That letter essentially bans transparency and democracy. It also treats the massive Chabad child sex abuse scandal as a bother and inconvenience for Melbourne Chabad’s trustees while offering no support at all for the victims of those trustees’ mismanagement and neglect.

More than all that, the letters make clear that while Chabad-Lubavitch’s Rebbe, Rabbi Menachem Mendel Schneerson, was alive, he took a special interest in and even controlled what happened in Melbourne. That means many of the child sex abuse coverups took place under Schneerson’s active and engaged watch.

The letters also show that the idea that Chabad worldwide is made up of independent franchises with no hierarchical control based in Chabad’s Brooklyn headquarters is false – something Chabad child sex abuse victims who are thinking of suing should take note of.

Manny Waks’ response to these letters:

I have deliberately stayed silent on the proposed governance ‘reforms’ that have been recently disseminated by the Melbourne Yeshivah Centre in response to last year’s Royal Commission. Some of the proposed ‘changes’ are concerning and appear no more than an attempt by the existing trustees to entrench their power when the only proper course of action is for them to resign. But rather than criticise, I wanted to afford the Yeshivah Centre the opportunity to properly consider its position and, to the extent that they’re prepared to speak up, to hear what the rest of the Yeshivah/Chabad community had to say.

However, it now seems that the Yeshivah Centre has been vetoed by the organisation that apparently has always had ultimate power, authority and responsibility: Chabad Headquarters, which is based in Brooklyn New York. It is important to note that since this scandal became public in 2011, Chabad Headquarters have remained silent for the most part, other than a solitary statement issued following the Royal Commission.

The intervention by Chabad Headquarters raises a number of questions about their responsibility for the child sexual abuse cover-ups within Yeshivah and their failure to speak out against the leadership and communal bullying and harassment of child sexual abuse victims, their families and supporters. At the same time, it again exposes the incompetence of the Yeshivah leadership who can’t even seem to clean up their own mess properly. I have briefly addressed each of these issues below, and reproduced the letter from Chabad Headquarters and the 1973 Merkos Guidelines they reference in their letter.

The Role of Chabad Headquarters

As is clear from the Chabad Headquarters letter, in their view at least, the Yeshivah Centre has at all times functioned under the ‘overarching authority’ of ‘the Rebbe zy”a and his representatives at Lubavitch World Headquarters in New York and in Melbourne’. The questions that need to be asked are: What did they know about the sexual abuse of so many children at Yeshivah? What did they know about the cover-ups? What did they know about the ongoing intimidation of victims, their families and supporters? Why have they waited until now to intervene? Were they comfortable with the way Yeshivah responded to victims of child sexual abuse or did they simply not view child sexual abuse as an issue worthy of their intervention?

As far as I’m concerned, they have had plenty of opportunity to have a positive impact on the Yeshivah Centre and community. Instead, they seemingly chose to stand idly by and allow the ‘Chabad ethos’ to be trampled. And now that their power risks being taken from them, they have intervened at the last minute. From my perspective, and that of the victims I’ve spoken to, it is too little too late.

During the Royal Commission, the global Chabad leadership were apparently too busy to speak to journalists. Perhaps now they can start answering questions about the responsibility of Chabad Headquarters for the sexual abuse of children seemingly within their institutions, the subsequent cover-ups of these crimes, followed up by the campaign of intimidation of victims, their families and supporters.

The Role of the Melbourne Yeshivah Centre Leadership

There has been much talk about changes occurring in the Yeshivah leadership since the Royal Commission. While there has been some positive change, including the installation by the trustees of an alternative Committee of Management and the resignation of some trustees, the reality is this: Every trustee who is running Yeshivah today was also running Yeshivah at the time of the abuse, cover-ups and intimidation. They are the same people who led Yeshivah to a Royal Commission and then promised to resign by the end of 2015. They are the same people who, rather than acknowledge their failures and move on, have seemingly proposed to entrench their power for an extended period. And a year after the Royal Commission, Yeshivah is still far from having good governance in place. The position in which they now find themselves is entirely of their own doing – rather than addressing the conflicts, acting transparently, honouring their past commitments and listening to some within their own community (and beyond) – they have carried on as they always have, as if a law unto themselves. After this latest debacle, hot on the heels of their broken promise to implement new governance by the end of 2015, they must all resign without delay.

That is not to say that the answer is for Yeshivah to again be accountable to a select group of Chabad Rabbis, as would seem to be the position of Chabad Headquarters. That model has been tried and has failed spectacularly. But it is to say (indeed to repeat) that those trustees who, by virtue of their leadership role there, have been responsible for what has transpired at Yeshivah cannot be part of the solution.

I believe the time has come where serious consideration needs to be given by the broader Jewish community and government as to whether it is appropriate for Yeshivah to continue under its current administration and in its current form. Australia’s Chabad community, including prominent Chabad rabbis, have allegedly engaged in “retaliatory attacks” against victims of child sex abuse and their families that are “akin to the Salem witch trials,” The Australian reported.

The Royal Commission into Institutional Responses to Child Sexual Abuse heard testimony yesterday from the wife of one of those child sex abuse victims about Chabad’s response to his decision to report the abuse to police. The woman, identified only by the initials AVC, reportedly cried as she ­described how her family was ostracized and testified that she has lost faith in Chabad community leadership.

“Our community has become a reincarnation of Salem, Massachusetts, of 1692 and the devil is everywhere. Rabbis preach against mesi­rah [informing on a Jew to non-Jewish authorities], preaching hellfire and damnation for those who have let the secular world in. The community’s response to their awakening to the child sexual abuse riddling the community is to turn on the victim and make them the subject of suspicion,” she reportedly testified.

The The Royal Commission is investigating the response of Chabad’s Yeshivah ­Centre and Yeshivah College in Melbourne and Chabad’s Yeshiva College in ­Sydney to child sex abuse abuse committed by Samuel David Cyprys, Daniel “Gug” Hayman and Rabbi David Kramer, along with alleged child sex abuse committed by others.

Chabad leadership in Australia has been accused by victims and advocates of engaging in widespread coverups of the abuse, some of whom have testified before the Royal Commission, as well.

Censorship: YouTube Pulls Video Of Chabadnik Beating Child

YouTube/Google again shows that it cannot be trusted. A security camera video from the Western Wall in Jerusalem showing a French Chabad-Lubavitch hasid brutally beating his daughter, made public in Israel and which has NO copyright, has been removed by YouTube for “violating” its “terms of service.”

YouTube is at it again, censoring a perfectly legitimate video that happens to make an organization some of its censors allegedly affiliate with look bad.

I posted on the video here at 12:46 am this morning, embedding the YouTube video that had been posted there a few hours earlier.

I also asked a reader to rip a copy of the video for me, because I was positive Chabad would have it censored within a few hours, because Google has a history of banning sites from its AdWords program that post legitimate news stories that are embarrassing for Chabad, and of deleting YouTube videos that do the same.

Shortly after that reader ripped the video, I went to bed.

I woke up to a phone call from another reader telling me the original video had been yanked by YouTube.

[Update 3:10 pm CDT – The reader who updated the video to YouTube and Vimeo for me just told me that the adults only warning and the requirement to prove your age before viewing the video is more Google censorship. Thereader did not restrict his upload in any way.]

YouTube’s excuse for this censorship will be that the video is violent.

There is no blood and the 12-year-old girl – while shaken and upset – is still walking and functioning normally after after the beating, and the man is seen being detained by bystanders and then being arrested by police.

The video was aired by Israel’s Channel 2 – which identifies it as security camera video – and has circulated widely in Israel since it aired late yesterday. It has no copyright.

It was uploaded to YouTube by an Israeli, and it’s description in Hebrew is as follows:

This video is no more violent than news video shown across the US every day on broadcast TV – and which is often posted on YouTube, as well.

YouTube’s real reason for removing this video is the same, I think, as it was when it removed IDF videos taken during Operation Cast Lead and released by the IDF to dispel lies told about it by Hamas, or videos right wing pundit Michelle Maklkin made.

Google wasn’t enforcing its policy – it was censoring someone or some organization or, in these cases, some country it’s censors doesn’t like and some pundit its censors don’t like, because none of these videos came even remotely close to violating any of YouTube’s terms of service.

YouTube’s censors clearly dislike Israel’s government and army, and that dislike prompts their actions.

In our case today, the video puts one group of people in very bad light – Chabad. Because on this video you see a Chabad hasid beating his 12-year-old daughter for no apparent reason, and in a way that is far more severe than the law would allow.

It is child abuse.

The security camera video of the incident serves two purposes beyond news – it puts this man’s community, friends and relatives on notice, making it far easier for police and child welfare to protect the child, the man’s other children, and his spouse and, secondly, it educates the haredi community about child abuse.

But YouTube cares nothing about that.

Hundreds of girls could be beaten just like this every day. YouTube’s censors would cluck and moan about the damage done to children by brutal men.

But the moment a video of an incident hits YouTube and makes one of the censor’s pet organizations or pet causes look bad, the video is pulled, censored.

What does that mean?

It means the girls’ voices are censored.

It means the removal of the best tool these tiny victims have to protect themselves and others.

And it is a dream come true for the men who beat, rape and abuse, a present to them of infinate value from Google, Inc.

This disgusting behavior permeates through all of Google, which behaves exactly the same way with its AdWords program and DoubleClick, and with every other service it offers – except, it claims, with search.

When the US Department of Justice serves Google’s founders and its CEO with subpoenas, when they become personally liable for their company’s unethical, illegal actions, perhaps this politically minded censorship will stop.

Until then, when you see Sergey Brin in a coffee house or on the street, don’t view him as a Silicon Valley rock star.

View Brin, Schmidt, and Page and the rest of Google’s board for what they really are: the people who leads the public book burning of some classic of literature that, nonetheless, offends them.

In fact, here’s a list of the members of Google’s board.

Make sure to let them know that you don’t appreciate Google’s censorship, that you have asked your Congressperson and Senators to ask the Department of Justice to investigate Google.

Thankfully, Israeli police arrested the man, determined that he has French citizenship, and deported him. They also notified French police and Interpol.

But the crime was committed in Israel and Israel chose to deport rather than prosecute the criminal.

That means he is probably free now in France, and able to beat his children oand his wife whenever the urge strikes, unless child welfare in France has stepped in strongly – but that does not appear to be the case.

That’s where you come in.

Show this video to every Chabad rabbi you know, especially if you are in France. Make sure that they understand that you care about this girl and that you want them to take steps inside the community to help protect her, her siblings and he mother.

If you know this man, do even more. Show the video to his parents and siblings, cousins, aunts and uncles.

Show it to the TV stations in his hometown and to the newspapers.

Make sure that he is exposed.

A man like this cannot live in a household with children, because the children will never be safe if he does.

Exposing him can make his removal from the household possible.

Horrific Haredi Child Abuser Guilty On All Counts

Self-styled rabbi convicted of perpetrating sadistic attacks on the children of a couple who became his followers; sentencing at later date.

Elior Chen 2 Jerusalem District Court Yoram Noam on Tuesday afternoon convicted Elior Chen of all charges against him. Sentencing will be at a later date.

In the meantime the self-styled rabbi’s lawyer, Ariel Attias, has already said that his client is innocent that that he will appeal the lower court decision to the Supreme Court.

Chen was found guilty of perpetrating sadistic attacks on the children of a couple who became his followers.

Attias charged that Noam had not allowed him to question the children who were victims of Chen’s acts. He also said that he had been given only five weeks to read all of the evidence involved in the case, whereas it had taken the court five months to do the same.

Last week, four of Chen’s disciples were sentenced to up to 20 years in prison for taking part in the brutal attacks against the children, one of whom has been in a coma ever since.

On November 23, Jerusalem District Court judge Nava Ben-Or sentenced David Avraham Kugman to 20 years in jail and a one-year suspended sentence and ordered him to pay NIS 200,000 in compensation to the children. Avraham Maskalchi and Shimon Gabai were each sentenced to 17 years in jail, a one-year suspended sentence and ordered to pay NIS 100,000 in compensation.

Roi Tzoref, who spent only part of the time during which Chen was in control of the children, was sentenced to 30 months in jail, six months suspended and ordered to pay NIS 10,000 in compensation.

The mother of the children, identified as M., has already been sentenced to five years in jail for her role in the affair. She turned state’s witness and testified against her former “teacher.”
