The ruling forbids a victim of sex abuse from testifying in secular court against his rabbi abuser.

This was originally posted on March 16, 2010.

I’m re-posting it now because this ruling was cited in the Baruch Lebovitz trial, and even though it was, the Brooklyn DA did not prosecute the beit din judges for witness tampering and intimidation.

And now that the DA is about to prosecute Samuel Kellner for allegedly extorting Baruch Lebovits’ son Meir, even though the evidence the DA has against Kellner seems to be trumped up, I thought it would be a good time to remind him that there are other haredi criminals who need to be prosecuted, men who intimidate witnesses and harass victims. And here you have hard evidence against one of them. I hope you use it, Joe.

PSAK DIN – JUDGEMENT

In the matter of the dispute-matter between the sides, that is Mr. ____ Side A the plaintiff, and between Rabbi Berl Ashkenazy shlit”a (should merit to long good years??) the defendant, side B, after the (sides) disputants agreed to heed the judgment of the dayan signed below, and after listening to the arguments and counter arguments of both sides, and after sorting out the facts and the halacha (Jewish law) ,the following ruling went out.

A. There is no obligation from side B to side A.

B. In contrast to this, it is forbidden for the young man (bochur) _____ to inform on side B (Rabbi Ashkenazy) to the courts (because) [that] he (talked on his heart) [tried to persuade him] that he should leave the courts, which is according to their laws a grave crime, and there is an obligation on side A to do whatever is in his ability to deter the above mentioned young man from this (mesirah) [informing].

C. Side B accepted on himself of his free will that he is prepared to help the above mentioned young man with whatever is in his ability to encourage him to go in good ways, however he will begin with him after the above mentioned young man will remove himself altogether from the courts of the goyim also in other matters.

And there are no more arguments and counter arguments between the sides, only peace to us and to all Israel.

Jewish Day School Textbook Challenged by Muslim Group for Vilifying Muslims

A Canadian Islamic organization is accusing a Toronto-area Jewish day school of using a textbook that vilifies Muslims.

In a Nov. 19 letter to Jewish groups, the Canadian Council on American-Islamic Relations, or CAIR-CAN, charges that a textbook used at the Joe Dwek Ohr HaEmet Sephardic School employs “inflammatory and hateful terms in describing Muslims.”

CAIR-CAN alleges that the book, “2000 Years of Jewish History,” describes Muslims as “rabid fanatics” with “savage beginnings.”

“The entire chapter devoted to Islam presents a pernicious and extreme portrayal of Muslims and the Islamic faith. The material further denigrates the Prophet Muhammad as a ‘rabid Jew-hater,’ and falsely portrays Islam as inherently anti-Semitic and devoted to hating Jews,” the group said in its letter to the Friends of the Simon Wiesenthal Center For Holocaust Studies and the Centre for Israel and Jewish Affairs, or CIJA.

It said the text is used in grade 7 and 8 girls’ classes at the Orthodox Jewish day school and “leaves impressionable young Jewish readers with a sense of suspicion and even intolerance towards their fellow Canadians.”

The group wants the Centre for Jewish Education of UJA Federation of Greater Toronto to investigate.

No one from CIJA, the Wiesenthal Center or Ohr HaEmet responded to JTA’s requests for comment.

CAIR-CAN’s salvo comes on the heels of an investigation by Toronto-area police of a local Islamic school. Earlier this month, police cleared the school of hate crimes allegations following a complaint by Jewish groups. York Regional Police found that teaching materials at the East End Madrassah attacked Jews and “suggested intolerance,” but were not criminal.

Part of the madrassah’s curriculum encouraged boys to keep fit for jihad, compared Jews to Nazis, and referred to “Jewish plots and treacheries.”

The complaint “prompted change” at the madrassah, noted CAIR-CAN in its letter, adding that the group “welcomes that change.”

When police began their probe, the Toronto District School Board,  which rented space to the school, revoked its permit and the madrassah had to relocate.

This man’s son is an adult, and has been described to me as Crown Height’s Jewish community’s major drug dealer.

The alleged drug dealer’s father is a senior member of a Crown Heights service group I’ll not (yet) name (Hatzolah, Shomrom, Shmira, etc.).

The alleged drug dealer impregnated a young Chabad woman in Crown Heights several months ago and another in North Miami Beach more recently. Both women come from ba’al teshuva families.

Chabad rabbis, including M.B. who is a very prominent Crown Heights rabbi, acting in conjunction with the the alleged drug dealer’s father, allegedly heavily pressured the women and their families to abort the babies.

Both women, especially the North Miami beach women, resisted. But under extreme pressure from Rabbi M. B. and other major rabbis in Chabad, the women each eventually gave in and had an abortion – the one in North Miami Beach allegedly terminated her pregnancy Thursday.

An Indian restaurant in the Machane Yehuda market in Jerusalem is reportedly the latest in a long line of food businesses which have dropped kosher supervision after facing what they say are “impossible demands” made by the state Rabbinate’s kosher supervisors.

Ichikidana dropped its kosher certification after Shmuel Zamelman, Machane Yehuda’s new kashrut supervisor, reportedly began forcing restaurants in the market to buy their vegetables from specific stores.

Lehava Silman Herman, who owns Ichikidana, told Ynet that having a kashrut certificate just wasn’t worth the trouble.

“We are a vegan restaurant,” Silman Herman said, “so the kashrut is irrelevant, but we decided to cooperate with the Rabbinate because of religious Jews. After [Zamelman] arrived and decided that we must only buy in certain stores, I decided that I would not cooperate any longer.”

But the Rabbinate claims the change in the market’s long standing practice is actually no change at all.

“Every restaurant which receives a kosher certification must take leaves and vegetables [i.e., leafy vegetables and non-leafy vegetables] from a supervised place only. This has been a Rabbinate order for the past 30 years. The Rabbinate does not profit from this arrangement.”

There can be several kashrut issues with vegetables, primarily related to bug infestation and tithes.

Yeshiva World reports that the will of the Shomrei Emunim Rebbe, Avrohom Chaim Roth, which was read Saturday night, orders that all of his sons – even his son in prison – should become rebbes in their own right:

The rebbe instructed all of his sons to serve as rebbes, including the  one in prison, adding they are not to take on the leadership role until  his release, which should be in the coming months.

What is the rebbe’s son in prison for?

Apparently for child sexual abuse, rape, sodomy, obstruction of justice and incest.

A siddur from 1471 has revealed an early example of egalitarian Jewish  prayer, presenting historical attempts to battle gender inequality. “This Siddur proves that the degrading attitudes towards women, which we  are seeing in certain extreme religious communities in Israel today,  are a modern distortion of Judaism,” said Rabbi Julie Schonfeld. “Ironically,  treatment of women in certain extreme sectors of the community is far  more denigrating to women today than even the attitudes of the late  Middle Ages.”

A siddur from 1471 has revealed an early example of egalitarian Jewish prayer, presenting historical attempts to battle gender inequality.

According to the Jewish Theological Seminary (JTS), the 600-year-old siddur replaces the traditional prayer recited by women, “Blessed are You, Lord our God, Master of Universe for Creating me According to your Will”, with “Blessed Are You Lord our God, Master of the Universe, For You made Me a Woman and Not a Man.”

The prayer offered by the 1471 siddur stands as a clear counterpart to the morning prayer recited daily by observant Jewish men: “Blessed are You For Not Creating Me a Woman”.

Rabbi Julie Schonfeld, executive vice president of the Rabbinical Assembly, Conservative Judaism’s official rabbinical association, discussed the prayer in light of current tensions between secular and ultra-Orthodox Jews in Israel.

“This Siddur proves that the degrading attitudes towards women, which we are seeing in certain extreme religious communities in Israel today, are a modern distortion of Judaism,” said Rabbi Schonfeld. “Ironically, treatment of women in certain extreme sectors of the community is far more denigrating to women today than even the attitudes of the late Middle Ages.

According to the JTS, the siddur was written by the scribe Rabbi Abraham Ben Mordechai Farissol, a well-known Northern Italian rabbi (1451-1525) who was a scholar, cantor, and physician. In addition, he wrote many interpretations of books in the Bible, and literature focused on comparing Judaism, Christianity and Islam.

The rare siddur is part of a collection of the JTS library, a Manhattan based academic and spiritual center of the Conservative movement.
