The ruling forbids a victim of sex abuse from testifying in secular court against his rabbi abuser.

This was originally posted on March 16, 2010.

I’m re-posting it now because this ruling was cited in the Baruch Lebovitz trial, and even though it was, the Brooklyn DA did not prosecute the beit din judges for witness tampering and intimidation.

And now that the DA is about to prosecute Samuel Kellner for allegedly extorting Baruch Lebovits’ son Meir, even though the evidence the DA has against Kellner seems to be trumped up, I thought it would be a good time to remind him that there are other haredi criminals who need to be prosecuted, men who intimidate witnesses and harass victims. And here you have hard evidence against one of them. I hope you use it, Joe.

PSAK DIN – JUDGEMENT

In the matter of the dispute-matter between the sides, that is Mr. ____ Side A the plaintiff, and between Rabbi Berl Ashkenazy shlit”a (should merit to long good years??) the defendant, side B, after the (sides) disputants agreed to heed the judgment of the dayan signed below, and after listening to the arguments and counter arguments of both sides, and after sorting out the facts and the halacha (Jewish law) ,the following ruling went out.

A. There is no obligation from side B to side A.

B. In contrast to this, it is forbidden for the young man (bochur) _____ to inform on side B (Rabbi Ashkenazy) to the courts (because) [that] he (talked on his heart) [tried to persuade him] that he should leave the courts, which is according to their laws a grave crime, and there is an obligation on side A to do whatever is in his ability to deter the above mentioned young man from this (mesirah) [informing].

C. Side B accepted on himself of his free will that he is prepared to help the above mentioned young man with whatever is in his ability to encourage him to go in good ways, however he will begin with him after the above mentioned young man will remove himself altogether from the courts of the goyim also in other matters.

And there are no more arguments and counter arguments between the sides, only peace to us and to all Israel.

It’s an all out dirty war.

The Daily News reports that since Rabbi Nechemya Weberman was convicted on 59 counts of sexual abuse Monday, his supporters in Satmar have told customers to boycott the victim’s parents’ businesses, pulled ads from Zev Brenner’s radio show in retaliation for interviewing Weberman’s victim’s husband and the DA, and spat on anti-child-sexual-abuse activist Rabbi Nuchem Rosenberg.

“It’s getting serious,” a source in law enforcement reportedly told the News.

It sure is – even more serious than the Daily News reported.
According to the victim’s husband Boory, after the conviction Weberman’s family threatened to have girls falsely claim that Boory sexually assaulted them when they were minors.

Rabbi Nuchem Rosenberg was attacked with bleach in Williamsburg the day after Weberman’s conviction.
One man, a hasid named Meilech Schnitzler, has been arrested in that attack, but police and the DA Charles Hynes insist the attack was not directly related to the Weberman verdict.

Rosenberg and his lawyer – Abe George, a potential candidate for Brooklyn DA – disagree. They also want Hynes to step aside and bring in another district attorney to prosecute the case. They believe Hynes won’t handle Rosenberg’s case fairly because of the years Rosenberg criticized Hynes’ inaction on and mishandling of haredi child sex abuse cases.

Even before the conviction, the victim’s family felt the sting of Satmar’s wrath.

At trial the victim testified that after she filed a criminal complaint against Weberman, her father’s business started losing clients, her nieces were kicked out of their Satmar school, and her husband’s restaurant’s kosher certificate was cancelled, forcing the restaurant to close.

After Weberman was found guilty, a text message was circulated in the Satmar community naming the victim’s mother and accusing her of “killing the Jewish Nation.”

“Please send around to at least 10 people. If you’re going to [name redacted] to make your face . . . you are a part of killing the Jewish Nation and five [Weberman] kids are home without a father,” the Daily News translation from Yiddish reads.

“The pressure — it’s unbelievable. I can’t take it anymore,” the victim’s mother told the Daily News.
The News also reports that what they identify as “sources close to the case” say that Weberman’s backers want to hire criminal defense attorney Alan Dershowitz to handle Weberman’s appeal.

In another example of Israel’s ethically challenged legal system, a synagogue gabbai who fled prosecution for the repeated rapes of a developmentally disabled child gets a short prison sentence on his return to Israel.

Yehezkiel Greenbaum, a 41-year-old Jerusalem synagogue gabbai, was convicted in a plea bargain today to charges of sodomy and indecent assault against a 14 -year-old boy with low mental function and personality disorders, Ynet’s Hebrew website reported.

Greenbaum fled the country in 2010 just before he was to slated to sign the agreement. When he recently returned to Israel, he was able to get some of the related charges dropped or altered, which reduced his sentence.

But Greenbaum also tried to claim that he had not forced the boys, a claim the judges rejected because of the boys’ mental states.

“The age gap and the close relations between the defendant and the complainant, as well as cognitive and emotional state [of the complainant], made the complainant easy prey for the defendant,” the judges said.

Greenbaum was sentenced to 30 months in prison.

The victim was so traumatized by the ongoing sexual abuse that he needed psychiatric hospitalization.

Just in case your haredi rabbi says there is no evidence that herpes can be transmitted by metzitzah b’peh (MBP) – the direct oral-to-genital sucking done by many haredi mohels to the baby’s bleeding penis after removing its foreskin – even though babies have died and been maimed by herpes infections transmitted through MBP, or if he says that a mohel who has no outward signs of herpes can safely do MBP, you can cite this study, which shows both claims of your rabbi to be false:

Objective: The aim of this study was to investigate the rate of herpes simplex virus (HSV) shedding from the oral cavity, because recent studies suggest that shedding is more frequent than originally reported. Factors that could influence the rate and duration of shedding from the oral cavity were examined.

Methods: Existing epidemiologic data from 22 reports of HSV shedding from more than 3,500 individuals were analyzed with regard to demographics, frequency of sampling, and methodologic assays.

Results: HSV-1 was more likely to be detected than HSV-2 in the oral cavity of asymptomatic persons (7.5 odds ratio, 95% confidence interval 4.4–12.8; P < .0001). The rate of shedding was highly variable among individuals, ranging from none to 92% of the days tested, and occurred in seropositive and seronegative individuals. In cell culture studies, the rate of detection on a single day was 6.3%. Polymerase chain reaction studies provided a different picture. HSV-1 DNA was present in 97 of 180 patients (53.9%) at multiple visits, with a rate of daily detection of 33.3%. The mean duration of shedding was between 1 and 3 days, but more than 3 days in about 10% of the patients.

Conclusion: At least 70% of the population shed HSV-1 asymptomatically at least once a month, and many individuals appear to shed HSV-1 more than six times a month. Shedding HSV-1 is present at many intraoral sites, for brief periods, at copy numbers sufficient to be transmitted, and even in seronegative individuals. The dental implications of these findings are discussed.

Herpes simplex virus (HSV) is a significant human pathogen infecting most individuals early in life, predominantly at mucosal surfaces after exposure to infected secretions. It has been implicated in a range of diseases including labials and stomatitis, blinding keratitis, and, rarely, encephalitis. According to the data, more than 70% of adults have neutralizing antibodies and serve as reservoirs of the virus. The authors have done an excellent systematic review of the rate of shedding of HSV from the oral cavity. Asymptomatic shedding is generally defined as the presence of HSV in the absence of clinical lesions. Based on this review, the frequency of HSV shedding at virus numbers sufficient to be transmitted are significantly higher than most clinicians would suspect. These high frequencies of asymptomatic shedding suggest that HSV-1 is not as dormant during latency as previously believed. This translates to the fact that even without clinical lesions, the dentist, dental hygienist, and chairside assistant are at risk. This data emphasize the importance of being diligent in maintaining proper infection control procedures (eye protection, gloves, mask) when performing routine dental examinations and procedures. All efforts should be taken to minimize splashes and splatters of oral fluids even in the absence of HSV oral lesions. Also, medical conditions, eg, immunosuppression and traumatic oral surgical procedures, increase the likelihood of virus shedding in the oral cavity.

ONE of Australia’s leading rabbis told a man whose son had been allegedly sexually abused by a youth group leader at a Melbourne Jewish school that the child would not need counselling because he was under eight years old, court documents say.
David Samuel Cyprys, a former security guard at the Yeshivah Centre in St Kilda East, has been charged with 53 offences, including six counts of rape, allegedly committed against 12 boys between 1982 and 1991.
He is contesting the allegations at a committal hearing in the Melbourne Magistrates Court.
In court documents, the parents of two separate boys said they went to Yeshivah Centre director Rabbi Yitzchok Dovid Groner in the 1980s to complain about alleged molestation.
The parents of both boys said no action was taken, with one woman saying her son was abused for another three years after her complaint.
One father said he told Rabbi Groner in 1984 that Cyprys had ”interfered” with his son. ” He told me that [the boy] wouldn’t need counselling because [he] was under eight years old,” the man said in a statement.
”Rabbi Groner told me he had spoken to psychologists before and they had told him because the children are so young counselling would not be necessary. Since that day I never heard another word.”
The mother of another boy said she called Rabbi Groner in 1987 after being ”shocked out of my brain” to learn of alleged abuse of her son.
”I recall when I mentioned David Cyprys’ name to Rabbi Groner he replied, ‘Oh, no, I thought we cured him’. By this I was sure that Rabbi Groner meant this sort of thing had happened before with David Cyprys,” the woman said in a witness statement.
Rabbi Groner, who was Melbourne’s most senior Chabad rabbi, died in 2008.
The court documents say Cyprys, who owns a locksmith business, has been affiliated with the yeshivah for many years. He was employed as a security guard, was a co-leader of a Jewish youth group there and was a martial arts instructor who recruited students from the school.
Cyprys, 44, of Balaclava, also supervised young males at the mikvah baths attached to the Yeshivah Centre, which are used for the spiritual cleansing of Jewish males.
”The accused was seen as a role model by members of the Jewish community who trusted him in the company of their children,” the summary of charges says.
The alleged victims, who were aged between seven and 17, say they were abused by Cyprys at locations including the mikvah bath house, Elwood houses, his van, Gan Israel youth camps and Yeshivah College.
”He was known as the ‘key master’. People knew this, and still do, and we were afraid of his reputation as being able to access everybody’s houses and also because of his martial arts prowess,” one alleged victim said in his statement.
”Cyprys was never shy about touching up kids. He was never violent, but you were scared, because he had the keys to everything, and he was a black belt at karate.”
Another alleged victim said Cyprys was ”a lot bigger and stronger than me at the time”. ”He had me pinned and cornered. I felt sick to my bones and wanted to die, I was so afraid.”
The man said that in the US, paedophiles in the Jewish community were reported to the police and dealt with accordingly. ”For some reason, the Jewish community in Melbourne covers things up,” he said in his statement.
Rabbi Abraham Glick, who was the principal of Yeshivah College between 1986 and 2007, said he had no recollection of any child or parent making a complaint to him about Cyprys molesting children.
”More recently it became known that the students did talk about David allegedly molesting children, but amongst the children there was a code of keeping this in ‘their world’,” Rabbi Glick said in his statement.
”The children did not discuss these issues with adults.”
Rabbi Glick, who still teaches at Yeshivah College and is the head of student wellbeing, said ”attitudes at the time were very different to current attitudes”.
”In those times it was a general practice that parents would not discuss these type of issues with anyone other than Rabbi Groner in his capacity as rabbi of the community and director of the colleges.”
The committal hearing is continuing before Magistrate Luisa Bazzani.

Groner’s brother was the Rebbe’s, Menachem Mendel Schneerson‘s, assistant.
